The privacy of your data — and it is your data, not ours! — is a big deal to us. In this policy, we lay out: what data we collect and why; how your data is handled; and your rights to your data. We promise we never sell your data: never have, never will.

This policy applies to all products built and maintained by GETMARKED, Inc. ("GETMARKED").

What we collect and why
Our guiding principle is to collect only what we need. Here’s what that means in practice:

Identity & access
When you sign up for a GETMARKED product, we typically ask for identifying information such as your name and email address. That’s just so you can personalize your new account, and we can send you invoices, updates, or other essential information. We’ll never sell your personal info to third parties.

Billing information
When you pay for a GETMARKED product, we ask for your credit card and billing address. That’s so we can charge you for service, calculate taxes due, and send you invoices. Your credit card is passed directly to our payment processor and doesn’t ever go through our servers. We store a record of the payment transaction, including the last 4 digits of the credit card number and as-of billing address, for account history, invoicing, and billing support. We store your billing address to calculate any sales tax due in the United States or VAT in the EU, to detect fraudulent credit card transactions, and to print on your invoices.

Website interactions
When you browse our marketing pages or applications, your browser automatically shares certain information such as which operating system and browser version you are using. We track that information, along with the pages you are visiting, page load timing, and which website referred you for statistical purposes like conversion rates and to test new designs. We sometimes track specific link clicks to help inform some design decisions. These web analytics data are tied to your IP address and user account if applicable and you are signed into our Services. Other web analytics we utilize are described further in the Cookies and Do Not Track section.

Security
The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

Cookies and Do Not Track
We do use persistent first-party cookies to store certain preferences, make it easier for you to use our applications, and support some in-house analytics. We partner with Google for some marketing activities. If you are coming to GETMARKED from a Google ad, and are in the United States, Google will send a cookie to your browser to determine whether you visited digitaliser.getmarked.ai because of a particular advertisement you viewed. This enables us to evaluate the effectiveness of these ads. A cookie is a piece of text stored by your browser. It may help remember login information and site preferences. It might also collect information such as your browser type, operating system, web pages visited, duration of visit, content viewed, and other click-stream data. You can adjust cookie retention settings in your own browser. At this time, our sites and applications do not respond to Do Not Track beacons sent by browser plugins.

Voluntary correspondence
When you write GETMARKED with a question or to ask for help, we keep that correspondence, including the email address, so that we have a history of past correspondences to reference if you reach out in the future. We also store any information you volunteer like surveys. Sometimes when we do customer interviews, we may ask for your permission to record the conversation for future reference or use. We only do so if you give your express consent.

Information we do not collect
We don’t collect any characteristics of protected classifications including age, race, gender, religion, sexual orientation, gender identity, gender expression, or physical and mental abilities or disabilities. We also do not collect any biometric data.

When we access or share your information
Our default practice is to not access your information. The only times we’ll ever access or share your info are:
  • To provide products or services you’ve requested.
  • To help you troubleshoot or squash a software bug, with your permission.
  • To investigate, prevent, or take action regarding restricted uses.
  • When required under applicable law. (e.g. National Security Letter or Foreign Intelligence Surveillance Act order)

Compliance with Privacy Laws
GETMARKED is compliant with the requirements of United States privacy laws including:
  1. United States: the Children’s Online Privacy Protection Act (“COPPA”); the Family Educational Rights and Privacy Act (“FERPA”)
  2. California: the California Consumer Privacy Act (“CCPA”); the Student Online Personal Information Protection Act (“SOPIPA”)
  3. Illinois: the Student Online Personal Protection Act (“SOPPA”)
  4. New York: Education Law Section 2-D (“Ed Law 2-D”)

Legal Basis for Processing Personal Data under GDPR

GETMARKED may process Personal Data under the following conditions:
  1. Consent: You have given Your consent for processing Personal Data for one or more specific purposes.
  2. Performance of a contract: Provision of Personal Data is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof.
  3. Legal obligations: Processing Personal Data is necessary for compliance with a legal obligation to which GETMARKED is subject.
  4. Vital interests: Processing Personal Data is necessary in order to protect your vital interests or of another natural person.
  5. Public interests: Processing Personal Data is related to a task that is carried out in the public interest or in the exercise of official authority vested in GETMARKED.
  6. Legitimate interests: Processing Personal Data is necessary for the purposes of the legitimate interests pursued by GETMARKED.
In any case, GETMARKED will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Your Rights under the GDPR

GETMARKED undertakes to respect the confidentiality of your Personal Data and to guarantee you can exercise your rights. You have the right under this Privacy Policy, and by law if you are within the EU, to:
  1. Request access to your Personal Data. The right to access, update or delete the information We have on You. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact Us to assist You. This also enables you to receive a copy of the Personal Data We hold about You.
  2. Request correction of the Personal Data that We hold about You. You have the right to have any incomplete or inaccurate information We hold about you corrected.
  3. Object to processing of your Personal Data. This right exists where We are relying on a legitimate interest as the legal basis for Our processing and there is something about your particular situation, which makes you want to object to our processing of your Personal Data on this ground. You also have the right to object where We are processing your Personal Data for direct marketing purposes.
  4. Request erasure of your Personal Data. You have the right to ask Us to delete or remove Personal Data when there is no good reason for Us to continue processing it.
  5. Request the transfer of your Personal Data. We will provide to You, or to a third-party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which you initially provided consent for Us to use or where We used the information to perform a contract with You.
  6. Withdraw your consent. You have the right to withdraw your consent on using your Personal Data. If you withdraw your consent, We may not be able to provide you with access to certain specific functionalities of the Service.

Exercising of your GDPR Data Protection Rights

You may exercise your rights of access, rectification, cancellation and opposition by contacting Us. Please note that we may ask you to verify your identity before responding to such requests. If you make a request, We will try our best to respond to you as soon as possible.
